The Public Service Disciplinary Tribunal is established under section 120 (9) of the Constitution to hear and determine disciplinary action instituted by:
The Public Service Commission against any Permanent Secretary; or
A Permanent Secretary, the Solicitor- General, the Director of Public Prosecutions or the Secretary-General to Parliament against any person employed in their respective Ministries or Departments.
Any decision of the Tribunal shall be subject to review by the High Court.
The Tribunal shall provide regular updates and advice to Parliament on any matter relating to its functions and responsibilities.
Powers of Tribunal
In the performance of its functions or the exercise of its authority and powers, the Tribunal shall be independent and shall not be subject to the direction or control of any person or authority, except by a court of law or as otherwise prescribed by written law.
Where the Permanent Secretary decides there is a discipline case for further action, the Permanent Secretary, in agreement with their Minister, may package all relevant information and refer to PSDT for determination.

Letter to the Employee for explanation of the allegation(s)
Response to the allegation(s) by the alleged Employee
Suspension letter (signed by PS)
Investigation Report – include documents as evidence
Submission coversheet to Chairman, PSDT – refer to the format under ‘Key Information’.
